Terms of Service
These Terms of Service ("Terms") govern your use of Heat Pump Dashboard (the "Service"). By creating an account or purchasing access, you agree to these Terms.
1. Who we are
The Service is operated jointly by:

- Dan Martinec, IČO 14233312, Nymburk, Czech Republic
Both of us are jointly responsible for the Service. Customer-facing payment receipts are issued by Dan Martinec's Stripe account; the Service itself is operated jointly under the joint controllership described in our Privacy Policy.

2. What the Service does
Cloudac is a web application that helps owners of Acond heat pumps connected via a Tecomat (Foxtrot) PLC visualise and analyse their telemetry data. The Service downloads data on your behalf using credentials you supply, stores it in a database, and renders charts and statistics for you.
We are not affiliated with Acond a.s., the manufacturer of Acond heat pumps, or with Teco a.s., the manufacturer of the Tecomat / Foxtrot PLC. The names "Acond", "Tecomat", and "Foxtrot" are trademarks of their respective owners and are used here only to describe what hardware the Service is compatible with.
3. Your account
- You create an account using an invite code we issue. You must provide a valid email address and choose a password of at least 8 characters.
- You are responsible for keeping your password secret. Notify us promptly if you suspect unauthorised access.
- One account per individual or household, with a maximum of two heat pumps per account. You must not share credentials.
- You must be at least 18 years old to register.
4. Subscription and payment
- Access to the Service is sold as a one-year non-recurring subscription. The price is shown on the website at the time of purchase. We are not VAT-registered.
- Payment is processed via Stripe. Card details are handled entirely by Stripe and never reach our servers.
- There is no automatic renewal. When your year ends, your access expires unless you choose to purchase another year.
- The Service is a digital service provided immediately after payment. At checkout you expressly consent to the Service starting immediately after payment and acknowledge that, under §1837(l) of the Czech Civil Code, you lose your right to withdraw from the contract within the 14-day period. Service-issue claims are assessed individually. See our Refund Policy for details.
5. Acceptable use
You agree not to:
- access heat pump data that does not belong to you;
- attempt to circumvent the Service's authentication or access controls;
- scrape, mass-download, or commercially redistribute data that belongs to other users;
- interfere with or disrupt the Service (e.g. denial-of-service attacks, abusive request volumes);
- reverse-engineer the Service except to the extent permitted by mandatory law;
- use the Service to violate any applicable law.
We reserve the right to suspend or terminate access for users who violate these rules.
6. Service availability
We aim to provide a reliable Service but make no specific uptime guarantees. Maintenance windows will be announced in advance where reasonably possible. The Service is provided "as is" — see Section 8.
7. Your data and content
- Your telemetry data is yours. You may export it at any time via the dashboard or by request. We do not use your telemetry data for anything other than providing the Service to you.
- You grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display your data solely for the purpose of operating the Service for you. This licence terminates when you delete the data or close your account.
- You are responsible for ensuring you have the right to provide the Tecomat / Acond credentials you use with the Service (i.e. the heat pump and portal account belong to you or you have permission).
8. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose and accuracy of the data. We do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
We are not responsible for: the heat pump hardware itself; decisions you make based on the visualised data (including energy-efficiency optimisations or repair decisions); outages or changes in the Tecomat portal or the Acond service; or third-party providers (Stripe, Resend, Hetzner) acting outside our control.
9. Termination
- You may stop using the Service or close your account at any time.
- We may suspend or terminate your account for material breach of these Terms, with notice where reasonably possible.
- On termination, we will delete your data within 30 days, except for records we are required by law to retain (such as invoices).
10. Governing law and disputes
These Terms are governed by the laws of the Czech Republic. The Czech courts have exclusive jurisdiction over any dispute arising out of or relating to the Service. As a consumer based in the European Union, you may also use the EU online dispute resolution platform.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email and via a dashboard notice at least 14 days before they take effect. Continued use of the Service after the change date constitutes acceptance of the updated Terms; if you don't agree, you may cancel your account and request a pro-rated refund.
12. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in effect.
